On this 18th day of November, 1885, personally appeared Margaret A. Carley, who, being duly sworn, declares that she is the lawful widow of Lot H. Carley, deceased; that he died on the 15th day of July, 1885; that he had been granted a pension by Certificate No. 226.005 which is herewith returned (or if not, state why not) because already sent to Commissioner of Pensions; that he had been paid the pension by the Pension Agent at Des Moines, Iowa up to the 4 day of June, 1885; after which date he had not been employed or paid in the Army, Navy, or Marine service of United States, except ----; that she was married to the said Lot H. Carley on the 18th day of February, 1864, at Fairplay, in the State of Wisconsin; that her name before said marriage was Margaret A. Daigh; that she hereby makes application for the pension which had accrued on aforesaid certificate to the date of death; and that her residence in No. ==_Street, City of North Auburn, County of Nemaha, State of Nebraska, and her Post-office address is North Auburn, Nemaha County, Nebraska.

Also personally appeared J. E. Daigh, residing at Auburn, Nebraska, and H. J. F. West, residing at Auburn, Nebraska, who, being duly sworn, say that they were present and saw Margaret A. Carley sign her name (make her mark) to the foregoing declaration; that they know her to be lawful widow of Lot H. Carley, who died on the 15th day of July, 1885; and that their means of knowledge that said parties were husband and wife, and that the husband died on said date are as follows: That they were neighbors and know of our own individual knowledge that the parties lived together as husband and wife in our midst and we were present at the funeral of Lot H. Carley at the time above stated.

PHYSICIAN'S AFFIDAVIT.

In the Pension Claim No. 341.726
of Lot H. Carley late of Co. E. 5th Iowa Cav.

Personally came before me, a County Court Clerk, in and for the aforesaid County and State, J. G. Harvey a citizen of Princeton, Kentucky whose Post Office address is Princeton, Kentucky and well known to me to be reputable and entitled to credit, and who, being duly sworn, declares in relation to aforesaid case as follows:

That he is a Practicing Physician, and that he has been acquainted with said soldier for about 13 years, and that He did not know the soldier prior to enlistment, that he has known him about thirteen (13) years, during much of which he lived in the same town with him, and knew him as a neighbor and as his family physician, that he has treated him at various times between the years 1868 and 1881, for billions fever, and other acute maladies.

That he knows him to be subject to frequent spells of sickness, caused by past exposure and diseases incurred before he knew him.

That he is not able to perform the duties of an able bodied man. and would consider his disability to be between one third and one fourth. That is . . . he would not be able to perform more than one third to one fourth of the labor of an able bodied man.

He further declares that he has been a practitioner of medicine for Twenty years, and that he has no interest either direct or indirect, in the prosecution of this claim.

Before me Clerk of Court in and for the aforesaid county and state dully authorized to administer oaths personally appeared Emma Allen, to me well known to be reputable and entitled to credit, who being duly sworn according to law, defuses as follows:

I have been acquainted with Lot H. Carley, applicant for Invalid Pension at least twenty years. He was sound and able bodied at and prior to his enlistment. He returned from the Army in poor health being troubled with scurvy, and a sever attack of Billions Fever, for which he was treated by Dr. Harney, who made the remark that the applicant's constitution had received a severe shock from his treatment in rebel prisons. The applicant was afterward treated by Dr. McBrien for scurvy, diarrhea and gen. debility. Dr. Harney was a resident of Jamestown, Grant Co., Wis. Dr. McBrien resided in Hagergreen, Grant Co., Wis. Dr. McBrien died about 3 or 4 years ago or about 1876 or 7. Dr. Harney is now servicing out a life sentence in Prison at Waupon Wisconsin.

The applicant has not had good health since his return from the army. . . . with the claimant, from the year 1854 to the present time and that she is totally disinterested in this claim.

Affidavit of Civil Surgeon or Physician.

On this 28th day of April 1879, before me County Clerk, in and for the County and State aforesaid, personally appeared C. A. Skens, who, being by me duly sworn according to law, deposes and says, that he is a Physician and Surgeon, in regular practice, and resides at Westmoreland, in the County of Pottawatomie, and State of Kansas, and was acquainted with Lot H. Carley, who he is informed, was a Lieut in Co. E, Fifth Regiment Iowa Vols., and attended or prescribed for him, as follows, for the following disease or disability: I was family Physician in his family from 1868 until he removed to Ill. in 1874 and during that time I have often treated him for Cephalagia of frequent occurrence and to such an extent as to disable him for days to attend to his ordinary employment arising from cause unknown to me evidently from some . . .

Deponent further says that the condition of the said Lot H. Carley after his discharge from the service aforesaid about October 1868, and while under his treatment He was, as stated above, unable often for days to work of to attend to his business and that as to his condition at the time of his enlistment in said service, about 18, and prior thereto, deponent says, I do not know.

Deponent further says, as to the habits of the said Lot H. Carley during his knowledge of him, that that of a sober temperate man.

And further, that he has no interest, direct or indirect, in this claim.

PROOF OF DISABILITY.

State of Iowa
County of Jones ss.

On this 11th day of December A.D. 1879 personally appeared before me a Notary Public in and for the aforesaid County, duly authorized to administer oaths Luther H. Brainard aged 41 years, a resident of Wyoming in the County of Jones and State of Iowa who being duly sworn according to law, states that he was acquainted with Lot H. Carley applicant for Invalid Pension; and knew the said Lot H. Carley to be the identical person of that name who enlisted or volunteered as a Private in Company E, Fifth Regiment of Iowa Cavalry Vols, and, and who was discharged at Clinton, Iowa on or about the Eleventh day of August 1865 by reason expiration of term of service.

That the said Lot H. Carley while in the line of his duty, at or near Andersonville, Savannah, & Millen Prisons in the State of Georgia, did from July 30 to Nov, 1864, become disabled in the following manner, viz: from exposure and insufficient food and its quality in the southern military prisons of Andersonville, Savannah, & Millen contracted diarrhea and scurvy, which so affected him that he could with difficulty help himself.

That the facts states are personally known to the affiant by reason of being with the claimant being captures with him, and released with him, and being with him all the time Night & Day during his imprisonment. The claimant was treated in Hospital Div No. 1, Annapolis Md. by surgeon Vanderkeift. After joining his Regt. he was often excused from duty from the effects of Prison treatment; before his capture he was never known to miss a turn of Duty.

And deponent further states that he was well acquainted with the claimant, having known him for at least four years, and further that his knowledge of the facts above stated was derived from said acquaintance, and from having served as a Sergt. of Company "E" Fifth Regiment of Iowa Cavalry Volunteers, from the 27 day of August, 1861 to the Eleventh day of August, 1865, And deponent further states that the claimant was a sound and an able-bodied man at and prior to enlistment, so far as he knew, and that he is totally disinterested in this claim.

Dear Sir:

In regard to the evidence called for by the Pension office I have to state: 1st that my diarrhea and scurvy were incurred while in Rebel Prison at the Andersonville, Savannah & Millen and that no commissioned officers were confined in those Prisons and that Capt. O. W. Langsbury was not in command of the company or with the Regt. at the time of my capture. The only officer with the company at the time was Lieut. Andrew Fouler, who was killed when I was captured. Will send the testimony of two comrades who were knowing to the facts. 2nd At the time of my return to the Regt. after Parole, I was considered fit for duty and entered upon that duty in the capacity of commander of Co. "A" of our Regt. Feb. 3rd 1865 until August 1865, at which time we were mustered out of the service, during my term of service after Parole I was only treated by a surgeon once for diarrhea and was then at Macon, Ga and attached to Gen. Uptons . . . with my Co. "A" and was treated or received medicine from the Div. Surgeon, whose name I have forgotten. Gen. Upton had the 4th Div. of Willsons Cav. Corp. We were then ending the Wilson Raid. 3rd The physicians who have testified in my case do not mention the diarrhea and scurvy because I have never called upon them to treat me for it, but for disability sometimes one thing and sometimes another, diseases that have no name other than Gen. Disability resulting from scurvy & diarrhea so they all resulted from the exposure incident to Rebel Prison Life.

PHYSICIAN'S AFFIDAVIT

In the Pension Claim No __________ of Lot H. Carley, Lieut. late of Co. E, 5th Regt Iowa Cav.

Personally came before me, a Notary Public in and for the aforesaid County and State B. J. Wise a citizen of Hannibal whose Post Office address is Hannibal, Missouri and well known to me to be reputable and entitled to credit, and who, being duly sworn, declares in relation to aforesaid case as follows:

That he was a Practicing Physician, and that he has been acquainted with said soldier for about four years, and that I was not acquainted with said L. H. Carley before his enlistment. I knew him from about July 1862 to July 1865 during the years of 1862 and 1863 knew him to be a sound man. Knew he was captured by the rebel army on what was known as the "McCoon raid" about July 1864, saw him during the early part of 1865 at Cavalry Depart, at Edgefield Tenn. Treated him while he was there for Diarrhea, scurvy and General debility, the effects of his imprisonment in rebel prison.

I have not seen or known him since his muster out of service.

This statement is from memory. I have no records of this case.

He further declares that he has been a practitioner of medicine for 10 years, and that he has no interest either direct or indirect, in the prosecution of this claim.

We have been acquainted with Lot H. Carley from the time he was 17 years of age and we knew him to have been a sound & health Person up to the time he entered the service of the U.S. in 1861.

And we further declare that we have no interest in said case, and that we are not concerned in its prosecution.

That since his death the said Margaret A. Carley has not remarried and is still the widow of the said Lot H. Carley and unmarried.

We further declare that we have no interest in said case, and we are not concerned it its prosecution.

Kersey aged 51 years, a resident of Union Township in the County of Pottawatomie and State of Kansas whose Post Office address is Louisville, Pottawatomie County, Kansas well known to me to be reputable and entitled to credit, and who, being duly sworn, declared in relation to aforesaid case as follows:

We were neighbors of Lot H. Carley and wife at the time their two younger children were born and we were both present at the time of the birth of Leroy C. Carley, who was born March the 13th A.D. 1871 and also at the birth of Harry D. Carley who was born January 25th A.D. 1873.

These are children of Lot H. Carley and his wife Margaret A. Carley.

We further declare that we have no interest in said case and are not concerned in its prosecution.

In the matter of the Pension Claim of Margaret A. Carley. Widow No. 330.706 Lot H. Carley, Sergt. Co. E 5th Regt. Iowa Cavalry.

Personally came before me a Notary Public in and for the aforesaid County and State Margaret A. Carley aged 40 residing at North Auburn, Nemeha County, Nebraska person of lawful age, who, being duly sworn, declares in relation to the aforesaid case as follows: There are no public records showing the date of death or any other fact relative to the death of Lot H. Carley deceased. The laws of the State of Nebraska do not require any such thing to be made a record of for anyone nor is any such record required by law to be kept.

As regards the ages and births of any children there were no church record written, none of them have been baptized nor were they members of any church. Nor were the names, ages or births of said children entered in any public record of any kind. There was no physician in attendance at the birth of any said children nor was there any mid-wife. I send the affidavits of my neighbors who were the persons present at that time and who know the facts of the time and place of the birth of said children.
